I. General information and definitions
- In all matters these Terms and Conditions, relevant provisions of the Polish Civil Code, of the Act on Providing Services by Electronic Means and other relevant provisions of Polish law shall apply;
- Terms and Conditions define the rules for using the online store available at www.jeremibyaga.com;
- The Owner of the online store available at www.jeremibyaga.com, also called the ‘Seller’ is:

The terms used in the Terms and Conditions mean:
- Customer (otherwise: Buyer) – a person, legal person or organisational, which places an Order in the Online Store;
- User – any person using the Website;
- Online Store (also the Website) – an online platform available at www.jeremibyaga.com, which consists of graphic elements and software enabling the provision of electronic services to customers;
- Civil Code – the Act of April 23, 1964 (Polish Journal of Laws No. 16, item 93);
- Regulations – these Regulations for the provision of electronic services as part of the Online Store available at: www.jeremibyaga.com;
- Sales Agreement – a contract for the sale of Goods within the meaning of the Civil Code, concluded between JEREMI Agnieszka Zarzycka and the Customer, concluded via the website www.jeremibyaga.com;
- Goods – a product presented with a detailed description on the Website;
- Order – Customer’s declaration of will, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods.

II. Terms of use of the Online Store
- The Seller, via the Online Store, provides Services consisting in enabling the conclusion of Sales Agreements between the Seller and the Customer;
- The condition to start using the Online Store is that the Buyer reads the Terms and Conditions and accepts them;
- Lack of acceptance of the provisions of the Regulations prevents the conclusion of a Sales Agreement;
- The technical requirements necessary to use the Website’s services are:
- having an electronic device with access to the Internet;
- using the current version of the browser through which websites are displayed (it is recommended to use browsers such as: Chrome, Firefox, Safari, Opera, Microsoft Edge);
- having an e-mail account (e-mail);
- The User is obliged to use the Online Store in a manner consistent with its intended use and refrain from any activity that could disturb its proper functioning;
- The Seller undertakes the necessary actions to ensure the correct and error-free functioning of the Website, in particular taking into account the current technical knowledge, and undertakes to remove irregularities reported by Users on an ongoing basis;
- The User has the option of registering a Customer Account in the Online Store, assigned to the e-mail address provided by the User;
- Logging in to the Website takes place using the Magic Link service (https://magic.link/), ie logging in without a password;
- In order to register a User Account and be able to log in to the Website, the User enters the e-mail address in the designated space (functionality on the Website), to which the Magic Link operator sends a confirmation of his willingness to log in to the store www.jeremibyaga.com – the User should log in to his the mailbox to which he wants to assign the User’s account, click on the confirmation link sent by Magic Link and return to the Website www.jeremibyaga.com;

III. Conclusion of the Sales Agreement
- The Seller accepts orders placed on-line 24 hours a day, all days of the week. Orders placed on Saturdays, non-working days and holidays will be processed on the first business day following the day on which the order was placed;
- The Seller enables the purchase of Goods on the website of the Online Store available at www.jeremibyaga.com, using the ordering procedure described below;
- In order to place an order in the online store www.jeremibyaga.com, it is necessary to:
- adding the selected Good to the Cart (Cart – Website functionality available in the Online Store);
- specification of the quantity of products;
- selection of the delivery destination;
- selection of the type of delivery;
- selecting the type of payment;
- fulfill the Customer’s billing data, including the billing address;
- if the delivery address is different from the billing address, it is also necessary to provide the delivery data;
- placing an order by clicking the “Buy and Pay” button;
- making the online payment;
- receiving an e-mail confirming the order by the Seller to the e-mail address provided by the Customer.
- Until the selection of the Goods is confirmed with the “buy and pay” button, the Customer has the option of making changes and modifications to the Goods in the order, as well as address data (billing and shipping).
- The Customer’s approval of the order by using the “buy and pay” button is tantamount to submitting by the Customer an offer to conclude a Sales Agreement, in accordance with the content of the order placed by the Customer and the Regulations;
- A prerequisite for concluding a Sales contract is immediate payment for the order using the available online payment methods;
- Unpaid orders (including orders with a payment made that have not been processed) are not accepted for execution and the Sales contract between the Customer and the Seller is not concluded;
- After receiving the order, the Seller shall send the Customer by e-mail to the e-mail address provided when placing the order, a declaration of acceptance of the offer, which is also the order confirmation. Upon receipt of the message by the Customer, a Sales Agreement is concluded;
- The Seller reserves the right to refuse an order if the data provided is so general that it prevents the order from being processed, and in particular prevents the correct delivery of the parcel. Before refusing to fulfill the order, the Seller will try to contact the Customer in order to determine the data in the scope enabling the order to be processed;
- The contract for the sale of Goods is concluded between the Customer and the Seller;

IV. Time of order fulfillment and Delivery
- The Seller carries out orders in the order in which they were received, i.e. after receiving information from the online transfer operator that the payment was correctly made by the Customer;
- The order processing time is counted from the moment the Seller sends a confirmation message to the e-mail address provided by the Customer;
- The order fulfillment time is up to 10 business days and does not include the time of delivery to the customer;
- The delivery of the Goods is carried out by the following carriers:
- UPS courier
- InPost (Parcel lockers)
- Post
- Personal order collection is not possible;
- Buyer is obligated to pay any additional costs beyond the control of the Seller (e.g. customs duties, local taxes);
- The goods are delivered to the address indicated by the customer when placing the order;
- The delivery costs are specified in the process of ordering the Goods;
- The proof of purchase is attached to the Goods (an invoice);
- After receiving the parcel, the customer should carefully check the condition of the packaging and its contents. In the event of any damage or other irregularities, he should draw up a damage report in the presence of the courier and notify the Seller immediately, i.e. within 3 days from the date of the report at the latest.

V. Prices and available Payment Methods
- Information on the purchase price of the Goods provided on the Website is binding from the moment the Customer receives confirmation of acceptance of the Customer’s purchase order for the selected Goods;
- All prices listed on the Online Store website are given in Polish currency (PLN), are gross prices including polish VAT;
- The customer has the option to change the currency displayed in the Online Store into USD (dollar) and EUR (euro);
- The amounts expressed in USD and EUR are the values resulting from the conversion of the price of the Goods expressed in PLN by the average exchange rate published by the National Bank of Poland (exchange rate from the last available day of publication of the National Bank of Poland, preceding the day of placing the order);
- The customer pays for the order at the time of its submission;
- The seller accepts payment methods:
- online payments made by the Stripe operator (https://stripe.com/), accepting payments by payment and credit cards (Visa, MasterCard, American Express, Discover, JCB, Diners Club);
- online payments made by Przelewy24 (https://przelewy24.pl), accepting payment methods as below:
- online payments via PayPal
- If there is a need to return funds for a transaction made by the Customer with a payment card, the Seller will refund the funds to the bank account assigned to the Buyer’s payment card;
- The Seller reserves the right to change the prices of the Goods, introduce new goods for sale, carry out and cancel promotional campaigns on the websites of the Online Store, or make changes to them in accordance with the standards of the Civil Code and other laws, and such changes do not violate the rights of persons who concluded contracts. sale of goods offered by the Online Store before the above-mentioned changes or rights of persons entitled to use a given promotion, in accordance with its rules and during its duration;
- The Seller has the right to update the prices on an ongoing basis and to include the Goods in promotions or sales of his choice. This right does not affect orders placed by customers before the above-mentioned activities.

VI. Complaints
- The Seller provides the Customer with Goods free from defects;
- The Seller is liable for physical and legal defects of the Goods in accordance with the principles set out in the provisions of the Polish Civil Code, and this is Art. 556 and following;
- The Seller is liable under the warranty if a physical defect is found before the expiry of 2 years from the date of delivery of the Goods;
- The consumer submits a complaint via e-mail to the following address: jeremibyaga@gmail.com;
- The complaint should include: Customer’s name and surname, correspondence address, e-mail address, telephone number, date and circumstances of the defect and a description of the request;
- Complaints are not subject to the following events:
- natural wear of the product, stretching of the skin and wiping of the load-bearing elements;
- using the Goods in a manner inconsistent with its intended use;
- improper care;
- mechanical damage;
- products with apparent defects that the buyer knew about on the day of purchase;
- splashes, soaking the product or other damage caused by exposure of the product to water
- The Seller is not responsible for damage or losses resulting from improper use of the Goods by the Customer;
- Positive consideration of the complaint is associated with:
- repair of the advertised Goods;
- if the repair is not possible, the replacement of the Goods with goods free from defects;
- lowering the price of the Goods and a partial refund for the purchased Goods with the consent of the Customer
- if repair and replacement are not possible, with the withdrawal from the Sales Agreement – refund for the purchased Goods within 10 business days.
- Along with the complaint submitted electronically, the Customer is obliged to return the defective Goods to the following address: JEREMI Agnieszka Zarzycka, ul. Budziszyńska 117/14, 54-436 Wrocław, Poland
- The Buyer is obligated to pay all costs related to the shipment of the advertised goods;
- The Seller does not collect parcels sent COD or delivered in person to the address of the Seller;
- The Seller responds to the Customer’s complaint within 14 calendar days from the date of its receipt along with the Goods to which it relates;

VII. Warranty
- The Seller provides a guarantee for the Goods within 12 months from the date of delivery of the Goods to the Customer;
- The Seller undertakes to remove physical defects free of charge if the defects appear within 12 months from the date of its issue or from the delivery of the Goods free from defects;
- The liability under the warranty covers only defects arising from causes inherent directly in the Goods sold;
- The Customer is obliged to report a defect in the Goods immediately after its detection, i.e. within 3 days at the latest;
- The Seller undertakes to perform the obligations arising from this warranty within 21 days from the date of delivery of the Goods;
- The warranty does not cover:
- mechanical damage caused by the customer,
- damage and defects resulting from the use and storage of the Goods not in accordance with their intended use;
- repairs undertaken by the customer on his own;
- splashes, soaking the product or other damage caused by exposure of the product to water
- damage resulting from improper care of the Goods by the Customer;
- The warranty does not exclude the Customer’s rights resulting from the non-compliance of the Goods with the contract.

VIII. Right to Withdraw from the Agreement
- The Customer has the right to withdraw from the Sales Agreement without giving any reason, on the terms described in these Regulations;
- The consumer is obliged to return the Goods to the Seller immediately, but not later than 14 days from the date on which he received the purchased Goods. The Goods should be sent to the following address: JEREMI Agnieszka Zarzycka ul. Budziszyńska 117/14 54-436 Wrocław Poland;
- Personalized goods at the Customer’s request, made in accordance with the comments sent by the Customer, are not subject to withdrawal or return;
- The consumer may withdraw from the contract by submitting a clear and unambiguous statement in this regard. For this purpose, he must independently formulate a statement and send it by e-mail to the following e-mail address: jeremibyaga@gmail.com;
- The Seller shall immediately send the Consumer a confirmation of receipt by electronic means of a declaration of withdrawal from the Sales Agreement by sending him an appropriate e-mail;
- As a result of the Consumer withdrawing from the Sales Agreement, the Sales Agreement ceases to apply;
- The Seller, no later than within 14 working days from the date of receipt of the return of the goods from the Buyer, will refund the amount for the purchases made, including the shipping cost, if the customer has incurred such costs (the lowest available at the time of the purchase by the Customer);
- The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different solution that does not entail additional costs for him. If there is a need to return funds for a transaction made by the Consumer with a payment card, the Seller will be refunded to the bank account assigned to the Customer’s payment card;
- Goods returned as a result of withdrawal from the sales contract should be properly secured by the customer before shipment;
- The Customer is responsible for damage and destroyed to the Goods during the return shipment to the Seller;
- Goods returned as a result of withdrawal from the sales contract cannot be used and should contain all originally attached tags and markings of the Seller;
- The returned Goods should beshould be return with a proof of purchase, if it was attached to the package (bill) and any accessories (including gifts from the Seller) that were provided with the Goods;
- The Seller may reduce the cost returned to the Customer as a result of withdrawal from the Agreement if the returned shipment has any acquired defects that reduce the value of the Goods (including damage caused during shipment);
- The costs related to the return of the must be paid by the Buyer and are not refundable by the Seller;
- The Seller has the right to withhold the reimbursement of payments received from the Consumer until the Goods are returned.

IX. Personal Data
- The Online Store available at www.jeremibyaga.com takes all possible technical and organizational measures required by applicable law to protect the personal data of customers, in particular to prevent the acquisition and modification of data provided during registration by unauthorized persons;
- Detailed information on the protection of personal data can be found in the Privacy Policy document available at www.jeremibyaga.com.

X. FINAL PROVISIONS
- All content posted on the website of the Online Store (including graphics, texts, page layout, logos, photos) benefit from copyright protection and are the sole property of the Seller. The use of this content without the written consent of the Seller shall result in civil and criminal liability.
- Any comments and complaints regarding the functioning of the Website may be sent by e-mail to the following address: jeremibyaga@gmail.com. The seller will provide feedback no later than within 14 days via e-mail.
- In all matters not regulated in the above Regulations, the relevant provisions of Polish law shall apply, including the Civil Code and the Act on consumer rights.
- The Seller reserves the right to amend these Regulations. The changes may not violate the rights of customers resulting from orders placed before the change was introduced. The amendment to the Regulations comes into force within 14 days of publication on the Online Store website.
